TERMS AND CONDITIONS

VERY IMPORTANT INFORMATION THAT YOU REALLY SHOULD READ....

 

OTNPHOTOGRAPHIC (Fozzie) PHOTO SHOOT INTRODUCTION

 

Hello and welcome.

Sorry this is the formal part, it's maybe easier to jot down everything you might need to know.

The terms that follows are mostly a guide for people that have never been to my studio or worked with me in the past.

Please try to read everything here, it is designed to be of help to you and to hopefully answer any queries you might have but, also, do not be frightened to ask me anything.  I do not bite  ;-)

1) Rules:  

 

I have three rules for my shoots, and these must be strictly adhered to at all times.  They are:-

  • The shoot HAS to be fun.  If the fun stops, then so does the shoot.

  • You, the model, do not EVER do ANYTHING that you do not WANT to do.

  • No one gets hurt.

2)  Booking a shoot

 

I always ask people to visit my booking page, (www.otnphotographic.com/bookings)  and this is because the dates are always changing quickly.  GREEN dates are the ones which are available.

If a green date has writing alongside it, that usually means the booking date is provisional.

If a date is BLUE, then that means that it has been taken already.

If a date shows in RED, then there is a problem there.

If it is in YELLOW, then that is usually for information purposes only.

Before I can confirm a shoot booking, I will ask for the following information: (this is purely to keep my own records up to date and is never given out to anyone else for any reason!)

Remember...  Once a booking has been made and it appears on the booking page, then it is SET IN STONE!  I will not be annoying you by messaging or ringing to see if you are still coming, nor would I expect you to check up on me to make sure I've not forgotten.  Once booked, all you need to do is turn up as arranged.   Obviously we can chat about what the shoot will entail etc, but the date is still yours, unless either of us has to cancel or rearrange.

4)  Times:  

 

Ideally, try to be at Polmont for around 10am (Before 10am is possible if notified beforehand) but the 10am request is very much dependent on train times and of course, traffic hold ups.

(Please keep in touch with me during your travel, that way I will know when to meet you, and where.)

 

We will shoot for as long as you are comfortable, up to a latest time of around 5pm +/-

5)  What to bring

 

I usually suggest a variety of outfits, matching lingerie, stockings/hold ups, shoes, nail polish, make up & jewellery/accessories.

In an ideal world, you could already have your hair, make up and nails done before you arrive but, if that is not possible, then time can be set aside for this.

 

I have an assortment of shoes/boots (size 5/6) and an assortment of “bling” jewellery.  There are a few outfits and accessories available.

6)  Chaperones

 

You can bring a chaperone if you feel the need to, but you are solely responsible for their behaviour.   If a chaperone misbehaves at all during the shoot, then the shoot will be terminated and you will be asked to leave.   If anyone steals anything, or become aggressive, then I will have no hesitation in calling the Police.    Sorry if this sounds a little draconian, but I have had trouble with chaperones in the past, but generally we usually get on quite well.

7)  Travel Costs

 

As a rule I do not ask anyone to cover my travel costs when I travel to them or to a location, and the same is expected in return.  The only time this rule will change is when a special circumstance has been negotiated beforehand.

8)  So where to head to for our shoot:

 

If you are coming by train, simply head to “Polmont” and I’ll pick you up at the station (I’ll drop you off as well).

When you get on the train, could you text me to let me know you have actually boarded and then, at the station before Polmont , (Either Linlithgow or Falkirk High depending on which direction you are coming from) can you RING me…  This will let me know to set off to meet you.  I will be in the car park.

Remember, when travelling from the Edinburgh direction, you will need to cross the footbridge at Polmont, and I will meet you at the far end of the platform.

9)  Cancellations: 

 

(a) I know people sometimes have to re-arrange a photo shoot or even cancel it outright, and this is never a problem “IF” you communicate with me in good time.  By good time, I mean giving me enough time to be able to ‘maybe’ arrange a replacement model.  It does not really do anyone any favours to cancel 1 minute before you are due to arrive.

(b) If you cancel the shoot (for whatever reason) within 48 hours, then that is not a problem.  Anything less than 24 hours notice MAY carry a financial penalty with it, and a cancellation less than 12 hours will most certainly carry a financial penalty (if no good reason is given).

(c) If you want to re-schedule, then that is again no problem, just let me know in good time.

(d) “No Shows” are totally unacceptable and unless a VERY good reason is given, then compensation will be sought.  It is also likely that I will not be booking another shoot with you following a "No Show".

(e) The KEY to avoiding problems here is COMMUNICATE WITH ME – it is easy and costs nothing.

11)  Breaks

 

Breaks are included and very much encouraged, as even if you do not need to stop, I often do (I am old!)  ;-)

Tea, coffee, light refreshments and biscuits, cake and snacks are usually on hand all day.

12)  Allergies:

 

I have cats.  They are very friendly, and may wander in to say “hello” – so, if you have an allergy to cats, it may be an idea to take a tablet as a precaution (Piriton often works).

13)  Smoking / Drinking / Drugs

 

Yes you can smoke, but you will need to do so by the back door, (ashtray provided). In extreme bad weather cases you can sometimes smoke under the cooker hood, (depends on the wife at the time as she is asthmatic).

Drunkenness will not be tolerated and you will be asked to leave immediately if found to be under the influence of alcohol.

Drug use of any sort will not be tolerated and you will be asked to leave immediately if found to be using drugs.

14)  Lunch

 

I am happy to put on a pizza or sandwiches etc, whichever you prefer, but could you let me know beforehand if you have any likes or  dislikes.

15)  Images

 

After the shoot is finished, you will get a disc with all the raw unedited images on it.  These images are yours to keep, BUT they are just “proofs” for you to look at and choose from.  You must not use these images anywhere, be it online or in print.  BOTH our reputations are at stake here.

Once you get the chance to look at the disc, you can choose any of a pre-arranged amount of images for me to edit.  You will need to make a note of the image numbers from the disc and then message me these numbers.  I will then go ahead and edit the images you have chosen and then I will email you the finished web size edited images to you.  These edits you can use online on your profiles etc, but they will not really be suitable for printing due to their size.  If you want prints, you will need to discuss that with me separately.

Please do not edit or alter any of the images from our shoot without first contacting me.

TYPES OF PHOTOGRAPHY THAT I UNDERTAKE:

a:  "T.F.P" (Time For Print)

From time to time, I may choose to work on a "TFP" shoot, but this is by no means guaranteed!  A TFP shoot MUST be beneficial to both parties, otherwise there is no point in working like this.Any images created on a TFP shoot MUST be chosen by the model for editing purposes.  ONLY the finished edited images may be used online or in print and may not be altered in any way.  Use of TFP images must be solely for promotional purposes, such as for inclusion in a portfolio.Unedited images may NOT be used for anything other than previewing.If images are to be used in any other way, then this must be discussed thoroughly, and agreed to by the photographer.A set number of images to edit will be agreed at the time of the shoot.Copyright will always remain with the photographer.Misuse of images created during  a TFP shoot will attract a fee of GBP£250 per image per day.

b:  "Profitshare"

Profitshare images work in a similar way to that of TFP images, in that they can be used for portfolio updates etc, however, images created on this type of shoot may also be submitted for commercial use.  Any image that is successfully accepted for commercial use and attracts payment will have its subsequent profits divided equally 50/50 between model and photographer.  This system is based 100% on trust, and if that trust is broken, then any agreements made will be void.Any images created on a Profitshare shoot MUST be chosen by the model for editing purposes.  ONLY the finished edited images may be used online or in print and may not be altered in any way.  Profitshare images may be used for inclusion in a portfolio or offered commercially (as agreed by both parties).Unedited images may NOT be used for anything other than previewing.If images are to be used in any other way, then this must be discussed thoroughly, and agreed to by the photographer.A set number of images to edit will be agreed at the time of the shoot.Copyright will always remain with the photographer.Misuse of images created during  a Profitshare shoot will attract a fee of GBP£250 per image per day.

c:  "Commercial (Unedited)"

If images are to be created for an agreed commercial purpose, then a set fee will be given. The set fee MUST be paid prior to images being released.Images created during the shoot will be handed over on a disc to the model concerned, to do with as they see fit.A copy of the images created will be held in archive and will be made available to the model should their copy disc become damaged or lost.Images from this type of shoot will NOT be edited or watermarked.Any monies raised from the sale of these images will remain with the model.

d:  "Commercial (Edited)"

If images are to be created for an agreed commercial purpose, then a set fee will be given. The set fee MUST be paid prior to images being released.Images created during the shoot will be handed over on a disc to the model concerned, to preview and then choose which images are to be edited.A copy of the images created will be held in archive and will be made available to the model should their copy disc become damaged or lost.Images chosen from this type of shoot will be edited and watermarked (as required).Unedited images should not be used anywhere.Any monies raised from the sale of these images will remain with the model.

e:  "Commercial (Other)"

Any images created within this category MUST be discussed and agreed upon prior to any work being undertaken. An individual contract of work may be drawn up as required.

PLEASE NOTE:

Should it ever happen that images I created  (“TFP” or “Profitshare”) and then discover that they have been sold on without my knowledge or consent, edited or not, for use online or in print, then I shall endeavour to recover any damages that would be due, if necessary via the Courts of Law.

As always, any misuse of images will ALWAYS carry a minimum penalty of GBP£250 per image per day.

16)  Copyright: 

 

Copyright of the images will always remain with the photographer.  (This is not a choice, it is laid down in Law and cannot be given away.)

Usage rights, however, are always negotiable and open to discussion.

17)  Payment

 

Payment is something that needs to be negotiated well in advance of a photoshoot.  Sometimes you will need to pay the photographer for images; sometimes the photographer will need to pay you for your time, and sometimes no one pays anyone.  In some cases you will hear the term “TFP” used (Time For Print, or more recently Time For CD) – The basics of a TFP shoot are that the images should ONLY be used for building up a portfolio and never should the images be used for commercial gain.

“Shoot for Shoot” is when the photographer needs a set of images, and you need a set of images.  Both sets can be produced on the same day or separate days, but each party should get their own set of images, which they can then go on to sell or distribute as they see fit. Neither party will  have a claim on the other party's images or monies raised. 

“Profitshare” is when both model and photographer have the opportunity to sell the images and split the profits from the sales equally.

18)  Model Release

 

In the United Kingdom there is no legal requirement for a model release to be signed, however it is something that is extremely useful for both parties, especially if it is intended to publish images in a magazine, or online and such like.  Often a magazine will not touch an image without a model release accompanying the images.   Always read a model release form before you sign it!
